Sony's now infamous decision to use system destabilizing DRM malware in order to "fight piracy" (despite it being shockingly easy to defeat) has earned Sony a lawsuit or three. A new class action suit has been filed in Los Angeles Superior Court, another is expected in New York this week, and there have been a handful of rumblings in other countries, as well.

In California, the class action suit alleges that Sony's DRM has caused harm to computers, and that the company failed to disclose precisely what the DRM technology would do to users' computers. According to sources, the suit alleges three distinct violations of California law, including violations of statutes relating to deceptive trade practices and obfuscated technological measures deemed to be anti-consumer. The suit seeks an injunction against the sale of the effected CDs as well as monetary damages for those who purchased the discs.

One group that doesn't seem to mind Sony's intrusive DRM are malicious trojan authors. Today came the first reports of viruses aimed at exploiting Sony's copy-protection.

Under a subject line containing the words "Photo approval," a hacker has mass-mailed the so-called Stinx-E trojan virus to British email addresses, said British anti-virus firm Sophos.

When recipients click on an attachment, they install malware, which may tear down the firewall and gives hackers access to a PC. The malware hides by using Sony software that is also hidden -- the software would have been installed on a computer when consumers played Sony's copy-protected music CDs.

Meanwhile Mark Russinovich, who first uncovered Sony's "rootkit" approach to DRM, has documented the ridiculous uninstall process. In doing so, he has demonstrated the danger that this rootkit presents to end users.

Sony doesn’t want customers to know that there’s DRM software installed on their computers and doesn’t want them to uninstall it if they somehow discover it. Without exaggeration I can say that I’ve analyzed virulent forms of spyware/adware that provide more straightforward means of uninstall.

Russinovich has also demonstrated how Sony's cloaking technique could cause systems to mis-report the causes of various crashes in instances where there were problems interacting with a device driver. In short, the entire thing is a joke. But not to worry, because Sony apparently thinks that none of it matters anyway, because consumers are ignorant.

And to wrap up, the EFF is also considering legal action, and is looking to hear from any users who have been affected by Sony's DRM.

This entire fiasco could be one of the best things to happen on the consumer's technology rights front in recent years. A few well placed law-suits may raise consumer awareness to the oncoming onslaught of unfriendly technological measures supposedly aimed at curbing piracy, and may even prompt a re-evaluation of tactics similar to those used by Sony.

They simply don't, or do not want to realize, that piracy is unstoppable. No matter what they do, and how much money they spend on it, someone will always crack that protection.
Why don't they spend their money more wisely?

the same sony is the same one who started piracy in the world... with the game console: Playstation 1... why was PS1 the best console in the world? because of piracy... nintendo is still number 1 in that!! but i know i'm going offtopic...

As Lista said, piracy can't be stopped, there's so much people who's able to crack those "protections"...

Piracy won't stop.

And I don't know in your countries, but if they want us to buy original albums (something which I AGREE, cause I like buying the original stuff!) they should low the prices... even the national records are that expensive. They make us copy and copy and copy. Is their fault. I'm sure that if they put reasonable prices, I'll buy a lot more original cd's than now. That's written.

yeh i also agree piracy will never be stopped!!! sony is just getting to greedy! they cant dominate the world! but with there that new stuff they were actually able to help hackers code malicious trojans! hehe Smile

i just want to say that u can get EIOP+ROTSC+TWM for 15 euros...the dynamite cd costs 17 €....

that is right its ridiculous the price fo some cds ive paid up to $45 for an album before which is just crap!
