Well I know one thing is for sure, if you have the original files and you are not being credited, then you have all rights to contact their marketing and let them know that your work is being used without your permission, the designer.
The fact that Derrick gave you the email says that they would like it to be fixed if it's truly a problem.
Here's the deal, Dye. You can either let them know to only credit you as the artist if you feel payment will make you look like a sellout, ask for royalties, or ask for them to take it down or you'll pursue a suit. There should be legal services within your town that will offer to help or some advice on the matter.
It truly is up to you, but honestly....I would really like to see you getting some credit for the infamous work they've been using for some years now. You have every right to say "hey guys, I created this and I would like to be credited for it's use." |

I found the files. They're .jpeg (with the original 2006 date). I have the original image I uploaded and each buffalo man in separate jpeg files. What I can't find are the photoshop ones.
What I'm trying to find is the post from Jamirotalk where I uploaded it the very first time. It should be late 2006.
If I'm gonna pursue some kind of credit, I must find every proof I have. |

Could you get cosmicmouse to help out or her husband to help find that post?
Also, you could either contact Derrick again (on his Facebook or try one of the other guys like Rob via his Twitter for it) for the marketing email regarding this, or you can take a chance and just use the email he gave you a couple of years ago. But I'd sooner contact Derrick just in case they have a new person handling things. |

Could be a legal thing for the Buffaloman's use, (registered trademark or something). But he actually isn't using the trademark Buffaloman. So his art is unique but tied to Jamiroquai. So there should've been some communication for use.
I hope you get something Dye, if at least your name printed at the bottom. |

Yeah, I found the Jamirotalk URL links from the first time I posted those buffalos in here. And the post hasn't been edited, so there's that.
I don't think I could get money out of that -don't know if I what to, either- but my name in the credits of the next album would be nice, for example. I don't know.
The fact is they've been using that image a lot. They used it in the background during a tv presentation in Brazil... ok fine. They made t-shirts... ok fine, I guess. But now they are in the official album releases... it's weird. I mean, I want a minimum retribution for that, at least. I think is fair. |

@HoneyBee: Yeah, that image is a total masterpiece. Its simple, elegant, and truly emphasizes the journey of the band and Jay himself. It's a classic piece.

Dude, none of that is fine.
The fact is, it's all been a stolen image used to sell the brand. Using it as background in a tv presentation, the t-shirts, the album releases...no man. This places you and the Jamiroquai brand in a compromising position. You're in an area where your loyalty as a fan and your artistic integrity are at odds with each other, while someone on the design end of the Jamiroquai marketing staff stole an image a fan made, claimed it as their own, and showed it to an unknowing Jay who approved of it.
It's messed up.
What's fair is that they credit you from now on whenever they use that image and make the person who stole the image pay for your concert tickets, accommodations, and travel fees for the next two to three years or the equivalent of how long they've been using the image. And that comes out of his/her own paycheck.
But, yeah, definitely use those urls and let them know you have the original files of your work dating back to 2006 and that you would like to be credited for your work. |

So, here is the deal for the ONE that selling Dye's design without his permission:
1) album, t-shirt and whatever else will now have credits on that kind of goods
2) no money to D! - all loss of salary goes to NvG
3) Dye receive NvG tapes immediatelly
I think everyone will be ok with that.  |
