I think I have original files .jpg and .psd of the bufaloman I made (The AFO/DYN one).
The problem is that these designs have been created from a previous design not made by us, and all rights belong to the original bufaloman are "in the band's side".
I don't know if there are any possibilities to get some credit or some benefits with this (who knows?)
The most funny thing is that I designed the bufaloman with a different hat to include it in a cover for a bootleg.

Actually yes there is.
Thing is, they are not the original buffaloman, they are variations of it. It's an altered version of a logo. Hence, they are not the product or property of Jamiroquai, but of you and Dyego.
Companies are very fickle when it comes to their logos because it's what represents them. Altering it creates something else entirely and since these other buffalomen were not created with the intention to sell a Jamiroquai product, but they were fanmade versions that were stolen and used for the brand without permission from the contributing artists, then you have every right to be credited in some way.
Here's something to remember, many artists create altered pieces of their favorite idols or trademarks and show them off for no profit (maybe). Since it's a form of expression, not stolen but inspired, it makes that work their own.
The buffaloman is registered (I'm sure). It would have been different if all version of the buffalomen you made were registered by Jamiroquai Ltd. before you and Dye made them. Then it would have be stolen and you guys would have no case. But since you were fans creating something for the fans to enjoy and it was stolen by someone who sold it for use....yes you have a case.
Don't second-guess yourself. Go get your due credit. |
